Is SEMS required by regulation?
Yes. SEMS is required for all operators on the US Outer Continental Shelf (OCS) under the BSEE regulation 30 CFR Part 250, Subpart S. The regulation was promulgated following the Deepwater Horizon incident and requires operators to develop, implement, maintain, and audit SEMS programmes that meet or exceed the requirements of API RP 75. SEMS audits by an accredited ASP (Audit Service Provider) are required every three years.
What is Stop Work Authority (SWA) under SEMS?
Stop Work Authority (SWA) is a SEMS element requiring that all personnel (including contractors) have the right and obligation to stop or refuse to perform any job or task they believe poses an imminent risk of serious harm to people, the environment, or equipment. Operators must establish a SWA policy, communicate it to all personnel, ensure that invoking SWA results in no retaliation, and demonstrate a positive safety culture where SWA is exercised without fear.
